Terms of Service

1. Acceptance of Terms

By creating an account or using WorkTime CRM ("the Service") at app.worktimealliance.com, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

WorkTime CRM is a cloud-based customer relationship management tool designed for home service contractors. Features include client management, pipeline tracking, estimate generation, calendar scheduling, and integrations with third-party services.

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • One account per company; you may invite team members within the platform
  • You must be at least 18 years old to create an account

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Upload or transmit malicious code or files
  • Attempt to gain unauthorized access to the platform or other accounts
  • Spam, harass, or send unsolicited communications through the platform
  • Reverse engineer, decompile, or copy any part of the Service
  • Resell or sublicense access to the Service without written permission

5. Payment Processing via Stripe

WorkTime CRM uses Stripe, Inc.("Stripe") to facilitate payments between contractors and their clients. Our platform acts solely as a software interface — we do not hold, process, or transmit funds ourselves.

  • Contractor accounts (Standard Connect):Each contractor is responsible for registering and maintaining their own Stripe Connect account (a standalone Stripe account under their legal entity). Funds from client payments are deposited directly into the contractor's Stripe balance and then to their designated bank account, never through WorkTime CRM.
  • Independent relationship:The contractor's use of Stripe is governed by the Stripe Connected Account Agreement and the Stripe Services Agreement. Contractors are solely responsible for Stripe onboarding, identity verification, tax compliance (including 1099-K reporting), chargebacks, refunds, and all obligations arising from transactions processed through their Stripe account.
  • Processing fees: Stripe charges standard processing fees (currently 2.9% + $0.30 per successful card transaction for US accounts, subject to change by Stripe). Each contractor can choose in their Settings who absorbs the card processing fee: the contractor (deducted from payout), the client (added to invoice total), or split 50/50.
  • No fiduciary role:WorkTime CRM is not a payment processor, money transmitter, or financial institution. We do not custody client funds. Disputes, refunds, and chargebacks are between the contractor, the client, and Stripe. WorkTime CRM may assist as a neutral software provider but has no control over the funds or Stripe's determinations.
  • Manual payment methods (Zelle, Check, Cash):When a client indicates payment via Zelle, check, or cash, WorkTime CRM records the submission for the contractor's convenience but is not involved in the transfer. The contractor is solely responsible for receiving and confirming such payments.
  • Platform subscription payments:WorkTime CRM's own subscription fees (if any) are processed separately through Stripe under our own merchant account and are subject to Section 7 below.

By using the Service's payment features, you acknowledge that WorkTime CRM is not liable for any failed, delayed, disputed, or fraudulent transactions processed through Stripe or any other third-party payment provider. Your sole recourse for payment disputes is with Stripe and the opposing party to the transaction.

6. Platform Subscription and Billing

  • WorkTime CRM offers a free trial period upon registration
  • After the trial, continued access requires a paid subscription
  • Subscription payments are processed securely via Stripe
  • Subscriptions renew automatically unless cancelled before the renewal date
  • Refunds are handled on a case-by-case basis — contact support within 7 days of charge

7. Third-Party Integrations

The Service integrates with third-party platforms including Google Gmail, Stripe, and others. By connecting these integrations, you agree to their respective terms of service. We are not responsible for the availability or behavior of third-party services.

8. SMS/Text Messaging

The Service includes SMS (text message) functionality that allows contractors to send transactional messages to their customers. By using this feature, you agree to:

  • Only send messages to customers who have provided their phone number and consented to receive SMS
  • Not use the SMS feature for unsolicited marketing or spam
  • Honor opt-out requests (STOP) promptly
  • Comply with all applicable messaging laws and regulations (TCPA, CTIA guidelines)

End users (customers of contractors) may opt out of receiving SMS messages at any time by replying STOP to any message. Message and data rates may apply. Message frequency varies based on project activity.

9. Data Ownership

You retain full ownership of all data you input into WorkTime CRM — including client information, estimates, and notes. We do not claim any ownership rights over your data. You grant us a limited license to store and process your data solely to provide the Service.

10. Data Deletion

Upon account cancellation or deletion, your data will be permanently deleted within 30 days. You may request an export of your data before deletion by contacting support.

11. Intellectual Property

All software, design, and content of the WorkTime CRM platform (excluding user data) is the intellectual property of WorkTime CRM. Unauthorized copying, distribution, or modification is prohibited.

12. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted availability, error-free operation, or that the Service will meet all your specific requirements. Use of the Service is at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, WorkTime CRM shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of data, revenue, or business opportunities.

14. Indemnification

You agree to indemnify and hold harmless WorkTime CRM and its officers, employees, and partners from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your violation of any law, or your handling of your customers' data — including any messages, estimates, or invoices you send through the platform. You are solely responsible for obtaining the necessary consent from your customers before adding their information to the platform or contacting them via email or SMS.

15. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or fail to maintain a valid subscription. You may cancel your account at any time from the billing settings.

16. Changes to Terms

We may update these Terms of Service at any time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict of law provisions.
